Q: Is thus dmv legal. can it be hanging from the mirror like that and the police will not pull you over

A: Yes. It does not obstruct your view in any way. It's completely legal. It's only one unit. No different than people hanging scent mobiles or other decorative items from their rearview mirror. Sadly I got pulled over recently, (speeding) and this wasn't even an issue. You'll be fine.
